Additionally, The New Detective reserves the right to refuse to provide and/or grant any user name and/or password that constitutes vulgar, obscene language, or language that might have a tendency to cause harm or confusion to any other user, organizations and/or persons.

The New Detective’s online educational website content is sole property of The New Detective and is protected by copyright and intellectual property laws of the United States; and shall remain the property of The New Detective and the individual contributing authors.  Users shall be permitted to print the content available through The New Detective for personal and non-commercial purposes and uses only. Material maintained on The New Detective website shall not be: retransmitted, redistributed, reused, rebroadcast or republished in any form whatsoever, in print or electronic form or elsewhere, unless permission has been granted in writing from an authorized representative of The New Detective.

RIGHT TO MODIFY TERMS OF SERVICE AND/OR TERMINATE SERVICES

The New Detective reserves the right and maintains sole discretion to terminate and/or modify any of the terms of this Agreement and Terms of Services, including but not limited to price, content, types of services, upon notice to the registered user. Therefore, In the event of any change, you, the registered user, shall reserve the right to terminate this Agreement and any provided services offered by The New Detective, but only upon written notice to The New Detective.

The New Detective shall post any and all changes concerning this Agreement and Terms of Service on The New Detective web site and may provide information concerning any and all changes via e-mail when practical.

This Agreement shall terminate automatically if you fail to comply with any term within or in the Terms of Service.

NOTICE SPECIFIC TO MATERIALS AND LINKS


The utilization of any materials protected by Copyright, including but not limited to graphics, text, photos, and sounds, is prohibited by applicable law.  Violations of such may expose the offender to severe criminal and civil sanctions.  It shall be the express policy of The New Detective to prosecute violators to the maximum extent possible by law.

The New Detective and any entity doing business with The New Detective shall stand mute regarding the suitability of the disclosures  maintained  in any work product and/or document and any associated or collateral work product held on the IX Web Hosting server and any other server associated with The New Detective for any purpose.   Everything shall be provided “AS IS”.  Any and all warranties, implied warranties and conditions of merchantability, fitness for any particular purpose, title, and non-infringement are hereby disclaimed by The New Detective and any other business doing business with The New Detective.  The New Detective will not and shall not become liable for any and all special direct and indirect or damages deemed or stated to be consequential or any damages whatsoever resulting from loss of use, profits, data, whether in an action argued to be contract, negligence or any other type of tortuous action, that stems from the utilization or performance of the server used by The New Detective.

The New Detective will under no circumstances, nor our partners, agents, and/or contributors or suppliers, become personally liable, or jointly liable for losses or damage of any kind caused by a user’s reliance or use of data and/or any information embedded within these discussion-type forums and/or services. The information and/or opinions displayed within these services shall be solely that of the person and/or entity making the posting, and shall not under any circumstances reflect the views maintained by The New Detective or any of its professional partners and professional affiliates. The New Detective shall have no legal obligation to constantly monitor these areas and the posted content, however, The New Detective will from time to time make attempts to respond in kind to complaints brought to our attention.

All users MUST agree and fully acknowledge that The New Detective shall legally reserve the specific right to monitor any and all electronic transmissions made through The New Detective web portal.  This will unequivocally include all chat rooms, forums, and any of The New Detective hosted or affiliated e-mail accounts.  The New Detective also and unequivocally reserves the legal right to specifically alter and redact or eliminate any materials without limitation, and remove any user from any associated The New Detective account, and to terminate this agreement should it be believed that any real or perceived violation of this agreement has occurred. Additionally, The New Detective further reserves the legal right to suspend services to any user for no reason whatsoever should it be believed that any real and/or perceived violation of this agreement has been, is being, or about to occur.

The New Detective shall immediately release and report such issues and information regarding suspicious electronic transmissions to any third party, to including police agencies and any legal and local, state or federal governmental entity worldwide.  This will be for the sole and specific purpose which will permit The New Detective to operate the web site properly, in addition to protect the best interest of everyone associated with The New Detective and all others.

V.    MISCELLANEOUS NOTICES

CHOICE OF LAW - CHOICE OF FORUM - WAIVER OF JURY TRIAL. The laws of the Great State of Florida, and the United States, shall govern all agreements within this document. Any legal dispute or lawsuit pled against The New Detective that has reference to this agreement or that arises in any other manner from the utilization or operation of The New Detective website shall be brought solely in a state or Federal court in and for Eighth Judicial Circuit, and more specifically, Levy County, Florida, unless The New Detective has consented in writing to a different legal forum.   It MUST also be agreed that any and all parties to such a pending cause of action shall agree to waive their respective legal right to a trial by a jury in any and all such causes of action that has been pled.
